Project Terms

Last updated: 8 October 2026

These terms cover the project work BuilderHQ (builderhq.io) quotes for, such as websites, custom software, search work and AI solutions. They are the full version of the terms printed on your quote.

Website subscriptions work differently. If you are on our yearly August website offer, or already have a website subscription with us, your subscription is covered by our Website Subscription Terms, not these.

1. Who these terms apply to

  • These terms apply to every project we quote for, once you accept the quote.
  • Your quote and these terms together are our agreement. Where your quote says something different from these terms, your quote wins.
  • “We” and “us” means BuilderHQ. “You” means the business we quoted.

2. Quotes and accepting them

  • Each quote shows the date it is valid until. After that date we may need to update the price or the timing before we start.
  • You accept a quote by paying the deposit, or by confirming in writing, for example by replying to our email.
  • All prices are in Australian dollars and are plus GST, unless your quote says otherwise.

3. Deposit and payment

  • A 50 percent deposit starts the work.
  • The balance is payable on launch, before your site goes live. For work that does not end in a launch, the balance is payable on completion. Your quote says which one applies.
  • Once work has begun, the deposit is not refundable. It covers time we have set aside for your project and work we have already done, and it is our genuine estimate of that cost. Section 14 covers what happens if the project ends early.
  • Invoices are due within 7 days.
  • If an invoice is overdue, we may charge interest on the unpaid amount at the Reserve Bank of Australia cash rate plus 4 percent per year, calculated daily from the due date. We may also recover the reasonable costs of collecting it, including debt collection fees and legal costs.

4. Timeline and what we need from you

  • Your quote lists what we need from you, such as content, photos, access and approvals, and gives an estimated timeline.
  • The timeline starts once we have the deposit and the content listed in your quote. If we are waiting on you, the timeline moves out by the same amount. If something on our side will cause a delay, we tell you as soon as we know.
  • We never need your passwords. Give us access by adding us as a user on the account, such as your hosting, domain, Google or ordering platform. You stay in control and can remove us once the work is done.

5. Revisions

  • A revision round is one consolidated list of changes, sent to us in writing within 30 days of the draft it relates to.
  • Changes sent separately after you have sent a round count as a new round.
  • Your quote says how many rounds are included. Extra rounds are quoted before we do them.

6. Changes to the scope

Anything outside the scope in your quote is quoted to you and approved by you in writing before we start it. We do not charge for extra work you have not approved.

7. Delays on your side

  • If the project is held up for more than 30 days waiting on your content, access or approval, the balance for the work completed so far becomes payable. If the work is finished and only the launch is waiting on you, that is the full balance.
  • If we then hear nothing from you for a further 60 days, we may close the project. We will email you before we do. Once the completed work is paid for, we hand it over to you as it stands.

8. Launch, domains and third party services

  • Launch needs access to your domain. A delay in getting that access moves the launch date.
  • Your site may rely on services run by other companies, such as your domain registrar, hosting providers, payment, ordering and delivery platforms like Square, Uber Eats, DoorDash and Abacus, Google, and email delivery. They run under their own terms. We are not responsible for their outages, fees or changes, but we will help where we reasonably can.
  • Fees those services charge, such as account, subscription and payment processing fees, are paid by you directly. They are not part of our fee unless your quote says so.
  • No one can guarantee a ranking in Google, Google Maps or AI answers, and we do not promise one.

9. Ownership and licences

  • Ownership of the completed site and the other deliverables in your quote passes to you when we receive final payment.
  • Licensed fonts, stock images, plugins and paid integrations stay under their own licences. They are not included in our fee unless your quote says so, and we quote them before we buy them.
  • We keep the tools, code, templates and know how we use across all our projects. Where they are part of your site, you get a permanent, non exclusive licence to keep using them as part of it.

10. Your content

  • Everything you give us, such as text, photos, logos, menus and prices, stays yours. You let us use it for the work in your quote.
  • You confirm you hold the rights to all content and images you supply to us.
  • If someone makes a claim against us because of content you supplied, you cover our reasonable costs of that claim. This does not apply to the extent we caused the problem, for example by changing your content or adding material of our own.

11. Portfolio

Once your project is finished, we may show it in our portfolio, case studies and on our website, along with your business name and logo. We never show anything you have told us is confidential. If you would rather we did not show your project, tell us in writing at any time and we will take it down.

12. Hosting and care after launch

  • If your quote includes ongoing hosting or care, it is billed monthly at the price in your quote, from launch unless your quote says otherwise.
  • Either of us can end it with 30 days notice in writing.
  • We use reasonable efforts to keep your site online, but we cannot promise it will never go down.
  • We keep regular backups. They are a safety net, not a substitute for your own records, so keep your own copies of your content.
  • When hosting ends, we take the site off our servers. If your project is paid in full, we give you a copy of its files on request.

13. Liability

Nothing in these terms excludes, restricts or changes your rights under the Australian Consumer Law, or any other right the law does not allow us to exclude.

Where the law allows us to limit our liability for failing to meet a consumer guarantee, our liability is limited, at our choice, to supplying the services again or paying the cost of having them supplied again.

To the extent the law allows, our total liability for a project is limited to the fees you have paid us for it. We are not liable for indirect or consequential loss, or for lost profit, revenue, sales or data.

14. Ending the project

  • Either of us can end the project by telling the other in writing.
  • If the project ends early, you pay for the work done up to that point. Your deposit counts towards it.
  • If we end the project and you have not broken these terms, we refund any part of your deposit that is more than the value of the work done.
  • Once the work done is paid for, we hand over everything completed.

15. Confidentiality and privacy

We keep your business information private. We share it only with the people and services that need it to do your work, or when the law requires us to.

We handle personal information in line with the Privacy Act 1988 (Cth) and our Privacy Policy.

16. Changes to these terms

We may update these terms. A change applies only to quotes we issue after it. It never applies to a project already underway or to a quote you have already accepted. The date at the top of this page shows when they last changed.

17. General

  • These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have jurisdiction.
  • If we disagree about something, we will both try to sort it out by talking it through before taking it any further.
  • If any part of these terms cannot be enforced, the rest still applies.
  • Your quote and these terms, together with anything we later agree in writing, are the whole agreement between us about the project. They replace anything said or written before you accepted the quote.
  • Notices go by email. We send them to the email address you gave us for the project, and you send them to hello@builderhq.io.
